Senior Counsel

Senior Counsel

The Senior Counsel is the primary contact for the organization on state and federal direct and indirect consumer finance legal matters impacting servicing and collections. This individual must develop strategies to execute on the business’ goals while communicating associated legal and compliance risks. The Senior Counsel will need to understand best practices to assist with the assessment of current and proposed practices. The employee must be able to oversee external counsel, work closely with compliance personnel and provide practical solutions and communication strategies to the line of business.

Essential Functions

  • Interpret state and federal regulatory requirements related to consumer loan, servicing, and collections.
  • Work with a variety of company departments to implement new products and services and to confirm that existing processes, disclosures, and customer communications are compliant with applicable law.
  • Address disputes related to collections and servicing matters, including management of external counsel.
  • Review policies, procedures, and practices to ensure compliance with legal requirements.
  • Assist the compliance department with non-bank lending requirements, fair lending matters and consumer protection standards.

Required Education and Experience

  • Juris doctor degree from an ABA approved law school
  • 4+ years’ experience as an attorney advising financial institutions serving consumers required (in-house experience preferred)
  • Licensed by and in good standing with at least one US state bar licensing authority
  • Knowledge and application of federal consumer protection laws and regulations, including but not limited to, ECOA, TILA, EFTA, FCRA, TCPA, CAN-SPAM, GLBA, UETA, ESIGN, FDCPA and UDAAP, and any state-level statutory and regulatory counterparts
  • Proficient in the utilization of Microsoft Office Suite
  • Attention to detail and accuracy required
  • Excellent verbal and written communication skills required
